Any dues paying resident of the Lake Barcroft community is welcome to join the Lake Barcroft Boat Sharing Program.
Joining the Boat Sharing Program requires a payment of $35 per household per year. We welcome additional contributions from those who are able.
Rules and Requirements
For the purposes of these rules, any person riding in a Lake Barcroft Boat Sharing (LBBS) Boat is considered to be using that boat, no matter the age of the person, and no matter whether they are propelling the boat or merely riding as a passenger in the boat. We ask that all members abide by the following rules and regulations:
Members must sign a liability waiver (see below) before using any of the boats and agree to assume all responsibility for any damage to the boats or injuries to members or guests sustained while using them.
Guests must sign a guest waiver (see below) before using any of the boats.
Boats may only be used during daylight hours, from sunrise to sunset.
Participants agree that they will be and are automatically entering into a contract with one another as Boat Owner and Boat Borrower, the terms of which include all provisions in this document, including those pertaining to the duties of owners and borrowers. That contract terminates when the boat is returned to its assigned space on the boat racks, but the Boat Borrower will remain obligated to compensate the Boat Owner for any damage that is incurred from the time the Shared Boat is unlocked until it is returned and locked. During this time, the Boat Borrower has full and exclusive responsibility for the Shared Boat and any harm it causes or incurs.
When a Shared Boat is borrowed, the Boat Borrower assumes full responsibility for any personal injury or property damage that arises from use of the Shared Boat. This applies to any Shared Boat that a Participant borrows, whether the Boat Borrower uses it personally or instead allows someone else to use it. Participants may allow guests they accompany to use Shared Boats that the Participant borrows, but only if the guest signs the Guest Assumption of Risk available for electronic signature at the Program website (barcroftbc.com). If the guest is a minor, the minor’s parent or legal guardian must sign the document, which they can access through the Program website.
Participants understand and agree that Shared Boats are not maintained or inspected by anyone except those Participants who use the boats. The Boat Owner has no obligation to inspect or maintain the boat once it is first made available as a Shared Boat. Before using any Shared Boat or allowing others to use any Shared Boat, the borrower has a duty to inspect the boat and ensure that it is in good and safe working condition. If the boat has damage or defects not reported in the Boat Listing available at the Program website, the Borrower must return the boat to its boat rack location, lock it, and promptly notify barcroftbc@gmail.com of the damage or defect. The Participant who last borrowed the boat will be presumed to be liable to the owner for the cost to repair or replace the boat. Failure to inspect a boat may make a Borrower liable for damage caused by a previous borrower.
The Borrower of a shared boat is responsible for use of that boat by a minor, a guest, or any person other than a Program Participant, and must be vigilant to assure that the user has supervision as may be appropriate considering their age, health, role in using the boat, and experience with the type of boat they use. The Program website (barcroftbc.com) has short tutorials that explain the basics of using various boats, including kayaks, canoes, and paddleboards.
If a Shared Boat is damaged, lost or stolen while it is borrowed (that is, between the time it is unlocked and the time it is returned to its storage location and securely locked), the Boat Borrower must indemnify the Boat Owner of the Shared Boat for the loss or damage.
Rules for Use of Shared Boats. For purposes of these rules, any person riding in a Shared Boat is considered to be using that boat, no matter the age of the person, and no matter whether they are propelling the boat or merely riding as a passenger in the boat.
a) No person may use a Shared Boat without a personal floatation device (“PFD” or life jacket).
b) A Shared Boat may be used only for recreational boating on Lake Barcroft.
c) A Shared Boat must be returned and locked in its boat rack position no later than 11:30 PM on the day the boat was borrowed. No Shared Boat may be removed from the boat racks between 11:30 PM and 4:00AM. Boats must be returned in clean usable condition (e.g., interior fully emptied of any water, sand or other materials, exterior wiped down).
A Participant may not allow any other person to use its Master Lock account to unlock Shared Boats. All adult members of a Participant’s household may become Participants by agreeing to the terms of this document and signing it by electronic signature available at the Program website (barcroftbc.com). All Participants will be given their own Master Lock account to allow them to unlock the Shared Boats. When a Shared Boat is unlocked using a Participant’s account, it will be presumed that the Participant has borrowed that boat, and a contract is automatically entered into between the Participant and the boat owner, as explained in paragraph 4), above. Allowing persons who are not Participants to access the Shared Boats will undermine the ability of the Program to accurately assess boat usage and determine a proper number of boats to accommodate a group the size of the Participants. A Participant’s unlocking of a Shared Boat for an unauthorized person will expose the Participant to liability for loss. The Program will not assume responsibility for unauthorized access. DO NOT allow anyone who is not a Participant to use a Shared Boat unless they are under your supervision.
After using a Shared Boat, the Participant is responsible for ensuring that it is locked properly. Participants who fail to secure the Shared Boat properly may be removed from the Program and/or held liable for damages caused by unauthorized use of an unsecured boat.
LBA Boating Rules Summary
Right-of-way. Mechanically-powered craft must yield to sail-powered craft, sail-powered craft must yield to craft powered by oars or paddles, and all watercraft must yield to swimmers or persons who are in the water for any other reason.
No boat in motion may be closer to a swimmer than 30 feet, other than to provide assistance in a bona fide rescue situation.
In no case may watercraft enter guarded and demarcated swimming areas other than to provide assistance in a bona fide rescue situation.
At night any boat out on the water must have at least a flashlight with which to signal its presence when approached by another boat.
“Slow zones” are established in areas of greatest danger to swimmers. These “slow zones” include the areas shown on the map to the right; and within twenty feet of all shorelines, docks, demarcated beach swimming areas and other structures.

Member Agreement
Before you request to become a member, please carefully review this Member Agreement section and sign the member agreement. By accessing and using the boat sharing program, you agree to be bound by these terms and conditions.
Membership Eligibility. To become a member of our boat sharing program, you must be a dues-paying resident of the Lake Barcroft community.
Boat Sharing Rules and Regulations. As a member of our boat sharing program, you agree to comply with all rules and regulations regarding the use of our boats. This includes following safety protocols, adhering to boating laws, and returning boats in clean and undamaged condition.
Liability Waiver and Indemnification. By becoming a member of our boat sharing program, you assume all risks associated with boating and agree to waive any claims against the program for personal injury, property damage, or any other harm caused while using our boats. You also agree to indemnify and hold harmless our organization and its affiliates from any claims, damages, or expenses arising from your use of our boats.

Guest Waiver
Anyone riding in a boat managed by the boat sharing program must either be a member in good standing of the boat sharing pilot program or must have completed a guest waiver.
